How Statutory Paternity Pay works

Statutory Paternity Pay is the lower of £194.32 a week or 90% of your average weekly earnings. It can be paid for one or two weeks, and is paid in the same way as your normal wages, with tax and National Insurance deducted.

It is also available to a partner of the person giving birth or adopting, including in same-sex couples, if they meet the conditions.

Who qualifies?

  • You must have worked for your employer for at least 26 weeks by the end of the 15th week before the baby is due.
  • You must earn on average at least £129 a week.
  • You must give your employer the right notice, usually by the end of the 15th week before the due date.

Paternity leave

Paternity leave lets you take time off around the birth. Your employer may offer more than the statutory amount, so check your contract. Your right to take the leave does not depend on how much you earn.
